Abstract

Explores strategic accounts of judicial behavior, reviewing literature on the forms of strategic behavior in courts around the world and the ways in which preference-maximizing judges interact with important players in their society. Discusses the three components of strategic analysis: judicial preferences, the institutional context, and the interdependencies between judges and other relevant actors. Surveys the major methodological approaches for conducting strategic analysis. Considers the ways that strategic analysis provides insight into the effect of internal and external actors on the judges' choices. Highlights opportunities for future research.
