Abstract
The article discusses law and economics in relation to the views of several legal scholars such as Guido Calabresi, Ward Farnsworth, and Ronald Coase regarding the absence of post-judgment bargaining in America. Nuisance and Jewish refusal to divorce (get) litigation are addressed, along with the concept of using legal damages in a civil action as leverage and as a basis for a possible transaction between adversarial parties.
