Case studies in Brazilian intellectual property rights

Abstract

This chapter aims to analyze a few cases regarding intellectual property in Brazilian industries and research institutes. It presents a study of a large governmental company with a strong research and development base, an industrial company with the internal capability for industrial research, and a new high-tech company of a science park. The chapter examines each of three sectors of the national economy (pharmaceutical, telecommunications, and capital goods) in relation to its interaction with the intellectual property system. The relationship between the science and technology institutions and the intellectual property system is very weak mainly because of the limited transfer of research results toindustrial applications. Due to its size and endeavors, CENPES is an important institution within the Brazilian intellectual property system. Many countries have adopted national intellectual property legislation which differentiates the pharmaceutical industry from the others.
