A Triptych of Regulators: A New Perspective on the Administrative State

Abstract

The article focuses on the three prototypes of U.S. administrative state's regulators, the guardian, facilitator, and technician. It examines the features of these regulators including their management of information, the modalities of their power exerted to the society, and the legitimacy concerns to their governance in public affairs. It is inferred that both the guardian and technician are execution-oriented, and both technician and facilitator furnish the ultimate decision maker.
