Abstract
בשנת תשע"ד חלו התפתחויות משמעותיות בפסיקה במשפט העבודה הקיבוצי בכלל ובדיני ההתארגנות הראשונית בפרט. סקירה זו מבקשת להתייחס להתפתחויות אלו בשני מישורים. ראשית, הסקירה מבקשת להאיר מספר התפתחויות בדוקטרינת חופש ההתארגנות ובכללן התפתחויות חדשות בשאלה מיהו ארגון עובדים, מהם כללי ההתנהלות הראויים בהתארגנות ראשונית ובהתמודדות בין ארגונית. כן, מציגה הסקירה את ההתפתחויות בנורמות הקובעות את אחריותו וחובותיו של המעסיק בתקופת ההתארגנות של עובדיו, ובנורמות הקובעות את הסעדים שיינתנו במקרה של פגיעה של מעסיק בחופש ההתארגנות.
